NOTICE OF PRIVACY PRACTICES
This notice describes how your health information may be used and disclosed and how you can access this information. Please read it carefully.

I. Our Commitment to Your Privacy

At Psychiatry Relief PLLC, we value your trust and are committed to protecting the privacy of your health information. We create and maintain a record of the care and services you receive to ensure quality treatment and meet legal requirements. This notice applies to all the health information we maintain and explains:

  • How your health information may be used and disclosed

  • Your rights regarding that information

  • Our legal duties under federal and state law

We are required by law to:

  • Keep your Protected Health Information (PHI) confidential

  • Provide this notice of our legal duties and privacy practices

  • Comply with the terms of this current notice

  • Update this notice as needed (updates will be posted in-office and online)

II. How We May Use and Disclose Your Health Information

We may use or disclose your PHI without written authorization for the following purposes:

Treatment, Payment, and Health Care Operations

  • To coordinate care with other providers or specialists

  • To bill and collect payment from insurance companies or responsible parties

  • To support healthcare operations, including training and internal evaluation

Example: If your provider consults with another psychiatrist regarding your care, PHI may be shared to ensure effective diagnosis and treatment.

Note: Disclosures for treatment are not limited to “minimum necessary” standards to ensure full clinical context.

Legal Proceedings

  • We may release PHI as required by a court or administrative order

  • In certain legal disputes, disclosure may occur through subpoenas or lawful requests, when permitted by law

III. Uses and Disclosures Requiring Authorization

We will not use or disclose the following without your express written permission:

  1. Psychotherapy Notes (unless for your care, legal defense, compliance checks, or emergencies)

  2. Marketing Purposes

  3. Sale of PHI

IV. Disclosures That Do Not Require Authorization

We may use or disclose PHI in the following situations without your authorization:

  • When required by law (e.g., abuse reporting, public health threats)

  • Health oversight (e.g., audits, investigations)

  • Judicial/administrative proceedings

  • Law enforcement requests (e.g., crime on-premises)

  • Coroners, researchers, or specialized government functions

  • Workers’ compensation claims

  • Appointment reminders or information about services and benefits

V. Disclosures You May Object To

You may choose to allow or object to disclosure of PHI to:

  • Family members or friends involved in your care

  • Anyone assisting with your medical bills

In emergencies, we may disclose this information and ask for your permission afterward.

VI. Your Rights Regarding PHI

You have the right to:

  1. Request Limits on Use or Disclosure
    You may request restrictions, though we are not obligated to accept them.

  2. Restrict Disclosure to Insurance
    If you pay out-of-pocket in full, you can request we not disclose that service to your insurance company.

  3. Request Confidential Communications
    You can specify how and where we contact you.

  4. Inspect and Copy Your Health Records
    We will respond within 30 days of a written request. Reasonable fees may apply.

  5. Request an Accounting of Disclosures
    You may request a record of disclosures made over the past six years (excluding disclosures for treatment, payment, and operations).

  6. Request an Amendment
    If you believe your records are incorrect or incomplete, you may request a correction.

  7. Receive a Paper or Electronic Copy of This Notice

VII. How to File a Privacy Complaint

If you believe your privacy rights have been violated, you can file a complaint with our office or directly with the U.S. Department of Health and Human Services.

We will not retaliate against you for filing a complaint.
